1. About us and these terms

1.1 www.oak-beams.com ("the Site") is operated by Oakmasters Ltd, trading as Oakmasters Frames Direct ("we", "us", "our"). We are registered in England and Wales under company number 03892478, and our registered office is The Lodge, Greentree Lane, Partridge Green, West Sussex RH13 8EU.

1.2 These terms govern your use of the Site, including our online design tools. By using the Site you accept these terms. If you do not accept them, please do not use the Site.

1.3 When you place an order with us, our terms and conditions of sale also apply to that order. If they conflict with these terms, the terms of sale prevail.

1.4 How we use your personal information is explained in our Privacy Policy.

2. Using the Site

2.1 The Site is provided free of charge for you to find out about our products, design oak trusses and porches, request quotations and place orders. You may use it for those purposes, as a homeowner or self builder, or in the course of your business as an architect, designer or builder working on a project with us.

2.2 We may change, suspend or withdraw the Site or any part of it, including any design tool, at any time. We do not guarantee that the Site will always be available or free from errors or viruses.

2.3 You are responsible for making sure that your device and connection are suitable for using the Site, and for keeping any account details secure.

3. Our design tools

3.1 The Site includes online design tools, currently the Truss Designer and the Porch Designer, and any further design tools we add ("the Designers"). The Designers let you configure a product, view it in 3D and send us your design for a quotation.

3.2 The Designers, including their software, code, design rules, calculations, 3D models, appearance and layout, were developed by us and are our property.

4. Our intellectual property

4.1 We own, or are licensed to use, all intellectual property rights in the Site and everything on it, including the Designers, text, photographs, drawings, graphics, logos and the selection and arrangement of the content. These works are protected by copyright and other laws in the UK and around the world. All rights are reserved.

4.2 "Oakmasters", "Oakmasters Frames Direct" and our logos are our trade names and marks. You may not use them without our written permission.

4.3 Apart from the limited permissions in sections 2 and 6, nothing in these terms gives you any right or licence to use our intellectual property.

5. What you may not do

5.1 You must not, and must not help or allow anyone else to:

• copy, reproduce, download, store, publish or distribute the Designers or any part of them, including their code, design rules or 3D models;
• reverse engineer, decompile, disassemble or otherwise try to discover how the Designers work, or work around any technical measure that protects them, except to the extent the law expressly allows this and cannot be excluded;
• use the Designers, their output or any other content of the Site to create, train or improve any product, tool or service that competes with ours, including any AI or automated system;
• embed, frame or link to the Designers so that they appear on any other website or app, or appear to be someone else's;
• use any robot, scraper or other automated means to access or extract content or data from the Site;
• remove or alter any copyright notice or other mark on the Site or its output; or
• use the Site for any unlawful purpose, or in a way that could damage, overload or impair it.

5.2 If you breach this section, your permission to use the Site ends immediately, and we may take legal action against you.

6. Designs and drawings you create

6.1 When you use a Designer, the resulting design, drawings, images, specifications and any price shown ("Output") are generated by our software and remain our property.

6.2 We give you a free, non-exclusive, non-transferable permission to use the Output for your own project, to view, save and print it, and to share it with your architect, designer, builder, structural engineer, planning authority and building control, for the purpose of obtaining a quotation from us or ordering from us.

6.3 You may not sell or publish the Output, use it commercially other than as allowed in 6.2, or supply it to any other manufacturer or supplier so that they can make, quote for or supply the design.

6.4 Designs prepared for you by us after an order, including manufacturing and machining files, belong to us and are covered by our terms and conditions of sale.

7. Accuracy of designs and prices

7.1 Output from the Designers is for guidance only. It is not a structural design, engineering calculation or confirmation that a design is suitable for your site, and it does not replace advice from a qualified professional.

7.2 Any price shown on the Site or by a Designer is an estimate. It is not an offer to sell, and a contract is formed only when we accept your order under our terms and conditions of sale. Prices and specifications may change before then.

7.3 We take reasonable care to keep the Site accurate, but we do not guarantee that its content is complete, accurate or up to date.

8. Information you send us

8.1 When you submit a design or enquiry, you confirm that the information you give is accurate, and you allow us to use it to respond to you, prepare quotations and supply our products. We handle personal information as set out in our Privacy Policy.

9. Our liability

9.1 Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law.

9.2 If you are a consumer, you have legal rights in relation to goods and services that are not affected by these terms. We provide the Site for domestic and private use, and we are not liable to you for any loss of profit, loss of business or business interruption.

9.3 If you use the Site in the course of a business, we are not liable to you for any loss or damage arising from your use of, or inability to use, the Site or its Output, or from relying on any content on it, to the fullest extent the law allows. We exclude all implied conditions, warranties and representations that may apply to the Site.

10. Links to other websites

10.1 Where the Site links to other websites, those links are provided for information only. We have no control over those websites and are not responsible for them.

11. Changes to these terms

11.1 We may update these terms from time to time. The version on the Site when you use it applies, so please check this page each time you use the Site.

12. Law and disputes

12.1 These terms are governed by the law of England and Wales. If you are a consumer, the courts of England and Wales have non-exclusive jurisdiction, and if you live in Scotland or Northern Ireland you may also bring proceedings in your local courts. If you are a business, the courts of England and Wales have exclusive jurisdiction.
